The FCA have now published their Policy Statement for CFDs and CFD-like options following the Consultation paper released in December 2018.
Whilst most of the measures are as expected the statement includes some interesting points to note, which may be a hint of things to come:
- The FCA statement applies to a wider range of products than originally covered by ESMA’s temporary intervention measures by including CFD-like options
- This extension of scope is applied despite specific feedback from other European regulators including the AMF and BaFin
- The FCA have clarified that they do not intend to capture firms that manufacture CFD-like options for sale through intermediaries outside of the UK
